Spitzer, Sheehan to sue Rochester coal-fired plant

New York’s attorney general and environmental conservation commissioner today said they plan to sue Rochester Gas and Electric Company for violations of the Clean Air Act at one of its coal-fired plants.
Spitzer sent the company a letter about violations at its plant in Greece, just outside Rochester.

Such a letter must be sent at least 60 days before a lawsuit is filed.

A spokesman for the company could not be reached tonight.

The state lawsuit will accuse the plant, which was built in 1948, of not installing required pollution controls.

So far, Spitzer’s office has filed lawsuits against companies with coal-fired plants in Ohio, West Virginia, Indiana and Pennsylvania.
